The instruments of protection of the parties to the cross-party proceedings on the constitutionality of laws in Spain

Abstract

The article aims to analyze some peculiarities of the interlocutory procedure for
the review of constitutionality in Spain. In particular, the present work is dedicated to the
study of the specific protection tools of the parties to the trial, such as the active
participation of the same during a given procedural phase before the common judge and
the possibility of raising a const itutional amparo for the failure to raise the issue by the
judicial authority. Furthermore, the article examines the reasons behind the interlocutory
procedure reform of 2007 which allowed the parties to the proceedings to participate in
the phase before t he Constitutional Court, its contents and its consequences.
