L'applicazione del principio del giusto procedimento dell'attività sanzionatoria delle autorità indipendenti alla luce della più recente giurisprudenza della Corte EDU
Abstract
Within the verdict, in reference to Grande Stevens and Others v. Italy, the European Court of Human Rights considering that the sanctions imposed by Consob for their onerous condition basically are to be part of the penal matter taking into account in this case, the safeguard of the fair trial on the basis of a further control by a judicial body holding full jurisdiction. The above orientation is shared by the recent jurisprudence of the Council of State, but highlights the subject of the problematic balance between the right to a defense and the requirements of an effective administrative sanction set within the sanction stage in front of the Consob.
