The premierate of the legislative bill A.S. 935/2023: criticism and perspectives
Abstract
The paper examines the content of the bill. 935, relating to the introduction of the direct election of the Prime Minister, of which some particularly problematic points are analysed. With this bill, there would be the transition from the parliamentary form of government to the so-called «premiered», with direct popular legitimacy and support from a parliamentary majority guaranteed by an anti-reversal rule and an electoral prize. Although it presents itself as a surgical reform since there are few constitutional provisions formally subject to the modification, the paper evaluates the consequences on the role and functions exercised by Parliament and the President of the Republic, which would dangerously compromise the balance between the different parts of the Constitution
